Terms of Use

These Terms of Use (the "Terms") govern your access to and use of Health Tracker (the "Service"), a free progressive web app for personal health and fitness tracking operated by Pratyush Aswal ("we", "us", "the operator"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Health Tracker is a free, self-service web application that lets you log and review personal health data — water intake, meals, workouts, sleep, weight, body measurements, energy, meditation, and supplements. It is not a medical device, and it does not provide medical, nutritional, or clinical advice.

2. Eligibility

The Service is intended for individuals aged 16 and older. By using the Service, you confirm that you are at least 16 and have the legal capacity to enter into these Terms.

3. Your account

• You must provide accurate information when signing up.
• You are responsible for keeping your password confidential.
• You are responsible for all activity that occurs under your account.
• Notify us promptly at the contact below if you suspect unauthorised use.

4. Acceptable use

You agree NOT to:

• Use the Service in any way that violates applicable law.
• Attempt to access another user's account or data.
• Reverse engineer, probe, or test the security of the Service except as permitted by law.
• Use automated means (bots, scrapers, crawlers) to access the Service.
• Overload, abuse, or attempt to disrupt the Service or its underlying infrastructure (Supabase, Vercel, USDA FoodData Central).
• Upload content that is unlawful, abusive, or that infringes third-party rights.

5. Health disclaimer

The Service is provided for informational and self-tracking purposes only. Any calculated targets (including BMR, TDEE, daily calorie, macro and water targets) are based on widely used estimation formulas (Mifflin–St Jeor) and are NOT a substitute for professional medical, nutritional, or fitness advice. Consult a qualified professional before making changes to your diet, exercise routine, supplementation, or medical treatment based on data shown in the Service.

You use the Service entirely at your own risk and assume full responsibility for any decisions you make based on information it displays.

6. Your content

You retain ownership of all data you enter into the Service (profile information, tracker logs, custom foods, etc.). You grant us a limited, non-exclusive, royalty-free licence to store, process, and display that data solely for the purpose of operating the Service for you. We do not sell your data, share it with advertisers, or use it to train machine-learning models.

7. Availability and changes

The Service is provided on a best-effort basis and runs on free-tier infrastructure (Supabase, Vercel). We do not guarantee uptime, response time, or freedom from errors. We may modify, suspend, or discontinue the Service (or any feature) at any time, with reasonable notice posted in-app where possible.

8. Termination

You may delete your tracker data at any time from Profile → Danger zone → Clear all data, and you may request full account deletion by emailing us at the address below. We may suspend or terminate your account if you breach these Terms or abuse the Service.

9. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, the operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or business arising out of or in connection with your use of the Service. Because the Service is provided free of charge, the operator's aggregate liability to you shall not exceed ₹0 (zero rupees).

11. Indemnification

You agree to indemnify and hold harmless the operator from any claim or demand arising out of your breach of these Terms, your misuse of the Service, or your violation of any third-party right.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced inside the app. Continued use of the Service after the effective date of a change constitutes acceptance of the new Terms.

13. Governing law

These Terms are governed by the laws of the Republic of India, without regard to conflict-of-laws principles. Any dispute arising under or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
